MARSHMIND IS A FISHING INTELLIGENCE PLATFORM ONLY. IT PROVIDES DATA-DRIVEN ZONE SCORING, SPECIES RECOMMENDATIONS, TRIP PLANNING TOOLS, CATCH LOGGING, WAYPOINT MANAGEMENT, AND AI-GENERATED SUMMARIES BASED ON PUBLIC NOAA, NATIONAL WEATHER SERVICE, AND SOLUNAR DATA COMBINED WITH PROPRIETARY ALGORITHMS. MARSHMIND DOES NOT GUARANTEE THE PRESENCE, CATCHABILITY, OR BEHAVIOR OF ANY FISH SPECIES. IT IS NOT SAFETY GUIDANCE, NOT NAVIGATION ASSISTANCE, AND NOT A SUBSTITUTE FOR PROFESSIONAL MARINE FORECASTS, CHARTS, OR LOCAL KNOWLEDGE. FISHING, BOATING, AND ALL OUTDOOR ACTIVITIES INVOLVE INHERENT AND SERIOUS RISKS OF INJURY, DEATH, PROPERTY DAMAGE, AND FINANCIAL LOSS. YOU ASSUME ALL RISKS. ALWAYS VERIFY CONDITIONS WITH OFFICIAL SOURCES, CARRY PROPER SAFETY EQUIPMENT, AND USE PROFESSIONAL JUDGMENT. MARSHMIND AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY HARM ARISING FROM YOUR RELIANCE ON THE SERVICE.

1. Acceptance of Terms

By accessing or using the MarshMind website (marshmind.com), mobile application (if any), or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must immediately cease all use of the Service.

2. Definitions

  • "Company," "we," "us," or "our" means MarshMind, with its principal place of business in Charleston, South Carolina, USA.
  • "Service" means the MarshMind SaaS fishing intelligence platform, including all websites, applications, APIs, content, features, and tools.
  • "User" or "you" means any individual or entity accessing or using the Service.
  • "Subscriber" means a User who has purchased a paid subscription.
  • "Content" means all text, data, images, scores, recommendations, AI outputs, catch logs, waypoints, and other materials made available through the Service.
  • "Intellectual Property" means the Service, proprietary scoring algorithm, zone database, AI models, user interface, design, logos, trademarks, copyrights, patents, trade secrets, and all derivatives.
  • "User Data" means catch logs, waypoints, trip plans, and other information you voluntarily submit.

3. Eligibility and Accounts

You must be at least 13 years of age and capable of forming a binding contract. Accounts are for individual natural persons only; corporate or shared accounts require prior written approval. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

4. Subscription Tiers and Billing

The Service offers three tiers: Free, Pro ($4.99 USD per month), and Master Angler ($9.99 USD per month). All paid subscriptions are billed monthly in advance via Stripe. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your account dashboard; cancellation takes effect at the end of the current billing period. No refunds are provided for any partial month or for the current billing period. Prices are subject to change with 30 days' notice. Stripe handles all payment processing; the Company never stores full payment card numbers.

5. License and Permitted Use

Subject to these Terms and your payment obligations (if any), the Company grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial fishing planning purposes only. You may not sublicense, resell, or commercially exploit any portion of the Service.

6. Intellectual Property

All Intellectual Property in the Service is owned exclusively by the Company or its licensors. You are granted no ownership rights. You agree not to (and not to attempt to): copy, modify, reverse engineer, decompile, disassemble, create derivative works from, scrape, data-mine, or redistribute any portion of the Service or its underlying algorithms, databases, or AI models. Any unauthorized use constitutes a material breach and may result in immediate termination and legal action. All rights not expressly granted are reserved.

7. User Content

You retain ownership of User Data you submit. By submitting User Data, you grant the Company a worldwide, royalty-free, perpetual, irrevocable license to host, store, process, analyze, and display it solely for providing and improving the Service. You represent that your User Data does not violate any third-party rights and is accurate.

8. Prohibited Conduct

You agree not to:

  • (a) access or attempt to access admin tools, restricted API routes, or data of other Users;
  • (b) use any robot, spider, scraper, or automated means to access the Service;
  • (c) interfere with or disrupt the Service or servers;
  • (d) upload malicious code or attempt to circumvent security;
  • (e) use the Service for any unlawful purpose or to harass; or
  • (f) allow any third party to do any of the foregoing.

9. Termination

The Company may terminate or suspend your account immediately, without notice or refund, for any breach of these Terms. Upon termination, your right to use the Service ceases immediately. The Intellectual Property, Limitation of Liability, and Governing Law sections survive termination.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY FISHING RECOMMENDATION WILL BE ACCURATE OR RELIABLE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO THE COMPANY IN THE THIRTY (30) DAYS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR FISHING OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Data, or your violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of South Carolina without regard to conflict-of-laws principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Charleston County, South Carolina. You consent to the personal jurisdiction and venue of such courts and waive any objection thereto.

14. Changes to the Terms

The Company may update these Terms at any time. Continued use after the effective date of changes constitutes acceptance. We will notify Users of material changes via email or in-app notice.

15. Miscellaneous

These Terms constitute the entire agreement. If any provision is held invalid, the remainder remains enforceable. No waiver is effective unless in writing. The Company may assign these Terms; you may not.
